Petition to expose Trafford Council's failure to care for the Wright family's disabled daughter and their refusal to implement the Local Government Ombudsman's recommendations.

Wilma Wright's fight for justice has taken three long years and, thanks to Trafford Council, continues to this day. She asked for assistance in the care of her daughter, Carly, in June 2005 but, in spite of numerous requests, Trafford Council refused to provide adequate support.

In July 2005, Wilma Wright submitted a complaint to the Local Government Ombudsman (LGO), the body responsible for investigating Council maladministration. In July 2007, they found in her favour and recommended Trafford Council should pay £100,000 as compensation for their actions regarding Wilma and her daughter.

Unfortunately, the LGO has no powers to enforce financial or other penalties and Trafford Council have simply refused to make any such payment. Wilma Wright has many supporters, including Public Service Ombudsman Watchers [1]. We are all trying to raise public awareness of this case in an attempt to help Wilma secure the compensation she deserves.

The actions of Trafford Council are beneath contempt but, unfortunately, Wilma Wright's case is just the tip of a very large iceberg. Some 18,000 complaints about Councils are submitted to the LGO every year but the vast majority of these fail to reach a satisfactory conclusion. Out of every 10,000 complaints submitted to the LGO only 64 of them are reported as maladministration with injustice.

Lengthy procedures and excessive delays by Councils force many complainants to terminate their fight for justice. In most cases, correspondence between Councils and LGOs, and conversations upon which their decisions are based, are not transparent and cannot be challenged by the complainant. In a court of law, all parties are aware of the evidence and have the opportunity to dispute it where appropriate.

There is also the important question of impartiality, all LGOs and their deputies are ex Council employees. This could, in part, explain why it is very rare for LGOs to find in favour of a complainant and report a Council's actions as maladministration.

In the few cases where maladministration is discovered, a 'Local Settlement' is often agreed between the LGO and the Council. In these circumstances no maladministration is reported and the complainant has no other option but to accept this outcome.

Unless an urgent reform of the current system is undertaken, Councils will continue to maladministrate in the knowledge that LGOs are impotent and biased. Even on the extremely rare occasion that they are found guilty of maladministration a growing number of Councils, like Trafford, are ignoring LGO's recommendations with impunity.

Whilst we are involved with monitoring the effectiveness of all Public Service Ombudsmen, we are particularly concerned about the extremely low levels of maladministration reported by Local Government Ombudsmen. For example the Parliamentary and Health Service Ombudsman reports maladministration in about 68% of cases submitted. In contrast, Local Government Ombudsmen report maladministration in only 0.64% of complaints submitted.


Was this serious embarrassment to the LGO moved by Cheshire County Council as...

Over the last couple of years or so if you visited Cheshire County Council's website and searched for the term 'Ombudsman' the first record always returned by their search engine was a case in which the Ombudsman had to apologise about a seriously bodged and flawed investigation. Any reference to that case has recently [within days of the Ombudsman publishing their report into Trevor's 2002 complaints.] been moved from the Cheshire County Council search page to a secondary search wider cheshire results. Was this serious embarrassment to the Ombudsman's office moved to a less prominent position as thanks to the Ombudsman for burying Trevor's 2002 complaints or is it just a coincidence? You decide.

OMBUDSMAN APOLOGISES TO FORMER MAYORS AFTER INVESTIGATION INTO LETTER ?CLANGER?

Two former Lord Mayors of Chester wrongly accused in an Ombudsman?s letter have received an unreserved apology. An inexplicably ?leaked? Letter of Enquiry concerning allegations of maladministration against Chester City Council made inaccurate claims against husband and wife Councillors Graham and Sue Proctor.

It maintained that the Proctors were ?out of order? because they had failed to object to a tree felling in a conservation area within the three week consultation period. But the couple ? who intervened in an attempt to protect the tree at the request of neighbours, when contractors turned up on site - had not even been told about the application.

Neither the Proctors, nor two other Chester City councillors representing the Vicars Cross Ward, had received any notification from the local authority.And no-one had even informed them that they had been criticised by the investigator. County Councillor Proctor demanded a full investigation into how the preliminary assessment was carried out.

In her reply, Deputy Ombusdman Beryl Bainbridge says that reference to the Proctors being ?out of order? was both ?inappropriate? and based on information later found to be ?factually incorrect?. The Deputy Ombudsman has apologised and admits that the letter should not have made any reference at all to Mrs Proctor because she is a County Councillor and not a member of the District Council.Today (Wednesday) County Councillor Proctor said: ?Justice has been done and I am delighted that we have received a full and unreserved apology.

?The report was leaked to the press and as a result we were attacked in letters from political opponents who based their criticism on references in a seven-week-old document which were completely incorrect,? said County Councillor Sue Proctor.?To make matters worse, Chester City Council Chief Executive Paul Durham had actually notified the Ombudsman of the report?s mistake some time before it was leaked to the press.

?All in all, we have been the victims of a ?clanger? which has had extremely unfair and unfortunate results.? ?This whole affair has been tremendously upsetting to both myself and my family,? said County Councillor Proctor, who returned from holiday to find the inaccurate report ?leaked? to the press. ?We had been judged and publicly attacked on the basis of incorrect information and without being given the chance to comment either to the Ombudsman?s investigator or Chester City Council.?

Chester City Council?s Chief Executive has subsequently confirmed that the Proctors had not received any prior notification from the City Council about the owner?s proposal to fell the tree.

?The initial view that the Proctors were ?out of order? was not based on an accurate understanding of the facts and, in my view, is inaccurate,? said Mr Durham. ?It was the City Council?s actions in respect of the proposal to fell the tree which was being investigated by the Ombudsman ? not the involvement of Councillors Graham and Sue Proctor.?

LGO: Freedom of Information

There are now 18 Freedom of information requests involving Local Government Ombudsmen on the WhatDoTheyKnow web-site. We are keeping track of them here because the WhatDoTheyKnow website does not publish details of reviews and appeal. If you have ever wanted to know something about Local Government Ombudsmen why not submit your own Freedom of Information request. It's easy and above all everything is available for everyone to read.


What Do They Know? update

There are already six Freedom Of Information requests to the Local Government Ombudsman on the What Do They Know website.

Would the Local Government Ombudsman provide all details of any expenditure it has incurred in relation to the identification of maladministration causing injustice by Trafford council and Trafford Council rejecting the Local Government Ombudsman's recommendations in relation to 'Carly'. Specifically, how much has the LGO spent in relation to an advertisement identifying that Trafford is a maladministering Council seeking to cause injustice as enabled by s31 of the Local Government Act.

Additionally would the LGO identify how many other Council's have following identification of maladministration and injustce simply changed Ombudsman.

LGO FOI request number 2, Longest undetermined complaint?) Which complaint has remained unresolved for the longest period of time? What was the reason for the delay? What was the subject of the complaint? Which Ombudsman/Ombudsmen were involved?

LGO FOI request number 3, Longest wait for a promised remedy?) What was/is the longest period of time a complainant has had to wait for a remedy promised to an Ombudsman by a Council, as a result of a finding of maladministration by the said Ombudsman, to be implemented? What was the reason for the delay? Which Ombudsman/Ombudsmen were/are involved?

LGO FOI request number 4, Trafford) Would you identify if any of the Local Government Ombudsmen ('LGO') have ever been employed by Trafford Council, and if so if this was an impediment to them being the Ombudsman with responsibility for this Council.

If this was not the case would you provide copies of all documentation maintained by the CLAE or the LGO themselves identifying why SEEX should cease to be the LGO for Trafford Council. This should include all documentation supplied to the Crown justifying the decision to exclude Trafford from the office of SEEX.

LGO FOI request number 5, Ombudsman's case load) For each of the three Ombudsmen, how many different citizens submitted complaints to them during the last reporting period.

Clarification: I am aware of the total number of complaints submitted during the last reporting period. I am also aware that many of them were counted more than once due to the way Ombudsmen record their statistics. What I am looking for is the number of individual citizens that submitted cases to the Ombudsmen during the last reporting period irrespective of how many different complaint numbers were assigned to their cases for statistical purposes by the Ombudsmen.

LGO FOI request number 6, Proportion of key employees that worked in local government?) Excluding support staff, what proportion of investigators, assistant ombudsmen and deputy ombudsmen have ever worked in local government or any of the other organisation that the ombudsman can investigate.

This years annual complaints report is by the assistant to the chief executive moira gibb. Don't actually know who the assistant is as the signature isn't readable.
Apparently camden council is having a review of its complaints handling which ties in with the councils 'customer service programme'. I think they dropped the word 'care' from the name of this programme, possibly because care doesn't actually come into the equation when camden council delivers most of its services, and most certainly doesn't apply to how the council handles complaints. But hopefully things may be changing - as it doesn't matter how many reports are produced saying this that and the other if the actual implementation isn't carried out satisfactorily by council officers. At least though it is recognised in the report that a change of attitude by council officers is required....

The supremo criminal class being those who call themselves the 'coun-cil';

Where the rich and famous look after themselves and their money and the most they have to grumble about is cobble stones and 'unfair' taxes levied on their precious four wheel drives.

Where the vulnerable and poor are routinely preyed upon by the criminal class coun-cil in order to either steal their homes, steal their money, or steal their self respect and dignity.

Take for instance phones calls I had this afternoon with two very disaffected camden residents.

One an elderly and disabled pensioner who not only has to cope with an illness which leaves him very tired, depressed and without hope of getting better, as a council leaseholder he also has to cope with council officers continually harassing him for leaseholder charges he does not owe.

The Conservative candidate for one of David Cameron's top target seats resigned yesterday, after being arrested over allegations of harassing his opponents.
Councillor Ian Oakley was released on bail by police investigating claims that prominent Lib Dems in Watford, including his rival parliamentary candidate, Sal Brinton, suffered a campaign of poison-pen letters, anonymous late-night phone calls and criminal damage.
The commuter-belt seat, held by Labour's Claire Ward with a majority of just 1,151, is a tight three-horse race between Labour, the Liberal Democrats and the Tories. Oakley's resignation is an embarrassing setback for Cameron, who needs to take such high-profile Middle England seats to win the next election.

FACT: The York LGO has created more anti ombudsman websites and blogs than any other ombudsman in the country.

The question the York LGO must ask herself is WHY? And then do something about it! The question I ask myself is why has she not done so long before now?


Radio Ga Ga

During the Radio 4 You and Yours programme today Anne Seex York LGO states that it is rare for a council to ignore an Ombudsman. Whilst that may be true for her colleagues it isn't true for herself, Trafford, Tynedale and Sefton (twice) have all decided that they have no confidence in her recommendations. When you take into account she only produces about 20 reports in any given 12 month period it would appear quite common for a council to ignore her. Mind you the majority of complainants never had any faith in the LGO in the first place so I suppose we can't blame local authorities when they start to agree with us.

The York LGO, has today declared herself 'functus officio' as far as my case is concerned. However, I think would be more accurate description of what she is trying to do would be

'quando omni flunkus, mortati'.

Local Government Ombudsmen don't want enforcement powers for one reason and one reason only. Article 6 of the Human Rights Act would be engaged. This would force them out of a cosy 'pseudo' judicial role, where they can conveniently ignore things like natural justice, legal and human rights. It would also mean they would no longer be in a position to bury maladministration for their friends and ex collogues still in local government and that's the last thing they want.


Analogy by design

A council tells the York LGO they can physically produce this. They even show them a plan view.

A complainant argues they can't and tells the ombudsman to refer to a cross sectional view to prove their point.

The York LGO refuses to take a cross sectional view into account and accepts the word of the council.

7 years later the York LGO finds the council not guilty of maladministration as far as the 'illusion' is concerned but guilty of delay in not actually producing it.

The council then decide not to produce the 'illusion' after all and the whole process starts again.

The York LGO thinks that's justice, whereas I think it's just an illusion.

Naomi Wimborne-Idrissi was angered when officials gave her the bill but instead of stumping up the cash she decided to chain herself to the pound's railings. More ...

Now she has been told that her appeal has been successful and she does not have to pay her fine.

A DOUBLE white line on the end of parking bays in the borough could lead to parking chaos.
Many residential bays are among those affected, meaning any tickets given to people parking there is effectively unenforceable.
The lines are on parking bays which have no individual bays marked inside them. Guidelines say these should be marked out by a single white line at either end, but in many cases workers have painted two.

The LGO's report

After many months in the making, the Local Government Ombudsman's report says
"...I do not consider that there has been any unreasonable delay in arriving at this point..."

AFTER TWENTY YEARS OF NEGLECT?????...and over three years of ignoring most of MY communications on the subject, while taking NO steps that have made the slightest difference???? I wouldnt like to be in the way of what is UNreasonable then!!!

When I had picked myself up off the floor, and banished the word "whitewash" from my ears, I realised that the LGO can only base his report on what he has been told bythe council. I have seen what he has been told, and quite frankly a lot of it is rubbish.

When I take off my "conspiracy theory" hat and discount the untenable notion that the council are deliberately misleading the LGO to buy more time...I am left with two theories:

1) Malcolm Morley considers the matter so unimportant that he hasn' t bothered to check his facts properly.
2) He is trusting his subordinates to tell hi...


MP Bill Rammell visits

At last, someone who may be able to make a difference has been to visit. Bill Rammell MP has been to view the problem for himself. You will also notice that he has been removed from the list of those who have singularly failed to respond to my communications on he subject. (Apparently there has been some sort of email "glitch" ad he has not been receiving my correspondence). Now that we have established a DIRECT line of communication to him, perhaps things will improve.

The meeting was extremely constructive: Mr Rammell made it clear to us that there IS indeed a problem, and that he thinks it is not "right" that the council has taken so long to deal with it. He is going to take the matter up with the council on our behalf.

As he pointed out, he does not run the council but perhaps his intervention may put a rocket under that backsides of those who are paid hundreds of thousands of pounds to do exactly that!
